2. Services
Roambit provides global data-only eSIM services for individuals and businesses. Our services may include prepaid data plans, digital eSIM delivery, account access, customer support, reseller services, promotions, credits, and related features through our website or mobile application.
Service availability, supported countries, supported networks, supported devices, plan validity, speed, and features may vary depending on destination, carrier availability, network conditions, local regulations, and technical limitations.
We reserve the right to modify, suspend, limit, or discontinue any service, feature, product, pricing, destination, or plan at any time, with or without notice, subject to applicable law.
3. Eligibility
To use our services, you must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher.
You must have the legal capacity to enter into binding contracts.
You must provide accurate, current, and complete information when placing orders, registering accounts, or otherwise using our services.
If you use our services on behalf of a business or another person, you represent that you are authorized to bind that business or person to these Terms of Service.
4. Account and Orders
You may need to create an account to purchase, access, reinstall, manage, or support certain services.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs through your account.
You must notify us promptly if you suspect unauthorized access, unauthorized purchases, or misuse of your account.
All orders are subject to service availability, payment authorization, fraud screening, and acceptance by Roambit.
We reserve the right to refuse service, reject transactions, limit quantities, block orders, or cancel purchases at our discretion, including where we suspect fraud, abuse, technical error, pricing error, payment risk, sanctions exposure, or violations of these Terms of Service.
5. Device Compatibility and User Responsibility
You are responsible for verifying before purchase that your device is eSIM-compatible, network-unlocked, updated where necessary, and otherwise capable of using the purchased service.
Roambit is not responsible for service issues caused by unsupported devices, carrier locks, manufacturer restrictions, software limitations, regional restrictions, incorrect installation, incorrect APN settings, disabled data roaming, incorrect mobile data selection, incorrect network selection, poor local signal conditions, or other user configuration errors.
You are also responsible for installing, activating, configuring, and using the eSIM in accordance with the instructions provided by Roambit.
Failure to follow the installation, activation, roaming, APN, network selection, or troubleshooting instructions provided by Roambit may prevent successful use of the eSIM. Such user-side setup or configuration issues do not, by themselves, mean that the eSIM is defective or that the service was not delivered.
Deleting an eSIM from your device, resetting your device, changing device settings, or otherwise removing access to an installed eSIM may prevent reinstallation or continued use in some cases.
If Roambit reasonably requests screenshots, device settings, network information, error messages, diagnostic details, or other troubleshooting evidence, you agree to cooperate with such reasonable support requests. Failure or refusal to cooperate with reasonable troubleshooting instructions may limit our ability to verify the issue and may affect refund eligibility.
6. Pricing and Payment
Prices are displayed in the currency shown at checkout or in the app at the time of purchase, which may include USD or other supported currencies.
Payments must be made using approved payment methods made available by Roambit or its payment providers, including credit card, debit card, PayPal, Apple Pay, Google Pay, or other supported methods where available.
All transactions are processed securely through third-party payment processors. Roambit does not store full raw payment card details on its own servers.
You are responsible for any applicable taxes, currency conversion charges, bank charges, card issuer charges, or intermediary payment fees not expressly included in the displayed purchase price.
We reserve the right to correct pricing errors, calculation errors, display errors, or obvious mistakes even after an order has been submitted, and to cancel or adjust affected transactions where permitted by law.
7. Refunds, Cancellations, and Withdrawal Rights
Refunds, replacements, credits, and withdrawal rights are governed by our Refund Policy, which forms part of these Terms of Service.
In general, eSIM products are digital services and may become non-refundable once they have been activated, installed for service, enabled, connected to a supported network, or used in whole or in part, subject always to mandatory rights under applicable consumer law.
To remain eligible for a full refund where applicable, the eSIM must not be activated, installed, enabled, connected, or used, unless Roambit Support instructs you to do so solely for troubleshooting.
If you are a consumer and applicable law grants you a right of withdrawal, that right will usually expire on the earlier of 14 days from purchase or the moment the eSIM is activated, installed for service, enabled, connected to a supported network, or used.
Approved refunds may be issued to the original payment method, as account credit, or as RoamCredits, as described in the Refund Policy.
Successful eSIM Delivery, User-Side Activation Failure, and Cost Deductions
Where an eSIM has been successfully generated and delivered to the customer by QR code, activation code, in-app installation method, email, customer dashboard, or any other digital delivery method, and our records or provider records indicate that the eSIM profile is valid, functional, and available for installation or activation, the service will be considered successfully delivered.
If the customer is unable or unwilling to activate or use the eSIM due to user-side factors, including but not limited to failure to follow the provided installation or activation instructions, disabled data roaming, incorrect mobile data selection, incorrect APN settings, incorrect network settings, use of an unsupported or locked device, device software limitations, regional restrictions, refusal to provide requested troubleshooting evidence, or failure to cooperate with reasonable support instructions, such circumstances will not automatically qualify as a defective product or service failure by Roambit.
In such cases, Roambit may, at its discretion and subject to applicable mandatory consumer law, offer troubleshooting support, replacement, account credit, RoamCredits, or a partial refund as a goodwill resolution.
Where a partial refund is approved despite successful eSIM generation and delivery, Roambit may deduct reasonable non-recoverable costs already incurred in connection with the transaction. These costs may include telecom provider charges, eSIM generation and provisioning costs, wholesale or purchase costs charged by the telecom provider, payment processing fees, transaction fees, support handling costs, and operational expenses.
Unless otherwise required by applicable mandatory consumer law, such deduction may include the applicable telecom provider purchase cost and an additional cost recovery deduction of up to 17.5% of the original transaction amount.
This deduction does not apply where Roambit determines that the eSIM was not successfully delivered, was technically invalid, could not be provisioned due to an error attributable to Roambit or its provider, or where mandatory consumer protection law requires a full refund.
Activated eSIMs, Connectivity Issues, and Provider Verification
If an eSIM has been successfully installed or activated but the customer reports that mobile data or internet connectivity is not working, Roambit may investigate the issue through its internal systems, technical logs, support checks, and, where applicable, direct verification with the relevant telecom provider, carrier, or network partner.
Where Roambit determines that the connectivity issue was caused by Roambit, its systems, the eSIM profile itself, or a provider-side provisioning or service failure, Roambit may offer a replacement, account credit, RoamCredits, or a refund, subject to applicable law and the circumstances of the case.
However, where Roambit or its telecom provider verifies that the eSIM was successfully provisioned, activated, valid, and technically functional, and the issue is not attributable to Roambit, its systems, the eSIM profile itself, or the telecom provider, the case will not automatically qualify for a full refund.
This may include, without limitation, issues caused by device settings, disabled data roaming, incorrect mobile data selection, incorrect APN or network settings, poor local signal conditions, unsupported or locked devices, customer-side configuration errors, failure to restart the device, failure to select the correct eSIM for mobile data, local network congestion, coverage limitations, or failure to follow reasonable troubleshooting instructions.
In such cases, if Roambit approves a refund as a goodwill exception, Roambit may deduct non-recoverable costs already incurred in connection with the transaction. These costs may include the telecom provider purchase or wholesale cost, eSIM generation and provisioning fees, payment processing fees, transaction fees, support handling costs, and operational expenses.
Unless otherwise required by applicable mandatory consumer law, the refundable amount may therefore be reduced by the applicable telecom provider purchase cost and an additional cost recovery deduction of up to 17.5% of the original transaction amount.
Customer Cooperation During Refund Reviews
Customers requesting a refund, replacement, account credit, or troubleshooting support may be required to provide reasonable evidence of the issue, including screenshots of device settings, eSIM installation status, mobile data settings, roaming settings, APN settings, error messages, network selection screens, device model information, operating system version, and any other information reasonably necessary to investigate the issue.
If the customer refuses, fails, or is unable to provide the requested information, or does not follow reasonable troubleshooting steps provided by Roambit Support, Roambit may be unable to verify the issue. In such cases, Roambit may decline a refund or may offer only a partial goodwill resolution, subject to applicable mandatory consumer law.
For refund terms, request procedures, timelines, limitations, and exclusions, please refer to the applicable Refund Policy on our website.
8. Fair Use Policy
Our services are intended for normal personal use and legitimate business use only.
You may not misuse, resell without authorization, redistribute without authorization, interfere with, exploit, reverse engineer, or use the service in a way that negatively affects our systems, third-party carriers, or other users.
We reserve the right to monitor service integrity, investigate suspicious or abusive usage patterns, and suspend, throttle, restrict, or terminate access where necessary to protect our service, partners, networks, or customers.
Examples of prohibited conduct may include abusive automation, excessive hotspot abuse where prohibited by a plan, fraudulent activity, attempts to bypass technical restrictions, network abuse, denial-of-service behavior, commercial resale without approval, or any unlawful use.
9. Unlimited Usage Policy
This section applies exclusively to plans marketed as unlimited. Fixed-volume plans are not subject to this section except where expressly stated.
Unlimited plans are intended to support normal day-to-day mobile connectivity. They are not intended for excessive, abusive, automated, bulk, or non-human traffic patterns, nor for usage clearly inconsistent with typical consumer or ordinary business travel usage.
You agree not to use an unlimited plan to intentionally download, upload, stream, relay, or transfer data in a way that is excessive, automated, continuous, exploitative, or primarily designed to maximize data consumption without regard to ordinary use.
This may include continuous large-scale downloads, continuous unattended streaming, automated synchronization at unusual volumes, machine-generated traffic, relay usage, or other conduct that unreasonably burdens partner networks.
What constitutes excessive, abnormal, or abusive usage will be determined by Roambit in its reasonable discretion based on the relevant facts, network conditions, plan type, destination, third-party carrier policies, and account history. We do not commit to a fixed threshold because usage patterns vary across plans and destinations.
If we identify usage that we believe is excessive, abnormal, or abusive, we may issue a warning, reduce speed, restrict access, suspend the service, terminate the plan, block future purchases, or permanently close the account, with or without prior notice where immediate action is reasonably necessary.
If excessive or abusive usage continues after notice or temporary restriction, the account may be permanently blocked. In such cases, no refund will be due for any remaining data balance, active validity period, or unused time, except where mandatory law requires otherwise.
10. Reseller Services
If you use our reseller services, partner tools, white-label services, or related business offerings, you agree to use them only for lawful and authorized business purposes.
You are responsible for your team members, sub-users, customer communications, branding, pricing where permitted, and all activity conducted through your reseller account.
We may approve, reject, suspend, or terminate reseller access at our discretion, including for fraud, abuse, reputational risk, policy violations, non-payment, inactivity, or legal concerns.
Additional reseller-specific terms, commercial terms, or separate agreements may apply. In the event of conflict, the more specific reseller agreement will control to the extent of that conflict.
11. Intellectual Property
All content, trademarks, branding, software, text, graphics, layouts, interfaces, databases, documentation, and other materials made available through our website, app, and services are owned by Roambit, its affiliates, licensors, or partners, and are protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, republish, scrape, frame, reverse engineer, exploit, or create derivative works from any part of our services or content without our prior written consent, except where expressly permitted by law.
Any limited right to use our services is a revocable, non-exclusive, non-transferable, non-sublicensable license for your personal or internal business use in accordance with these Terms of Service.
12. Third-Party Services and Networks
Our services may depend on third-party mobile carriers, telecom operators, payment processors, app distribution platforms, hosting providers, analytics providers, verification tools, hardware manufacturers, and other partners.
We do not control and are not responsible for the acts, omissions, outages, delays, coverage limitations, routing decisions, restrictions, pricing changes, throttling, maintenance, or policies of third parties.
Availability, speed, latency, and service quality may vary by country, carrier, device, location, radio conditions, lawful interception requirements, and external factors beyond our control.
For troubleshooting, refund review, fraud prevention, service validation, or technical verification purposes, Roambit may rely on information received from telecom providers, carriers, network partners, payment processors, fraud prevention providers, and other relevant third parties.
Where a telecom provider, carrier, or network partner confirms that an eSIM was successfully generated, provisioned, activated, valid, functional, connected, or technically available for use, Roambit may rely on such confirmation when assessing support requests, refund eligibility, replacements, account credits, RoamCredits, or other resolutions.
13. Suspension and Termination
We may suspend, restrict, or terminate your account, orders, eSIMs, credits, or access to services immediately if we reasonably believe that you have breached these Terms of Service, violated applicable law, engaged in fraud or abuse, created risk for us or our partners, or used the service in a manner that may harm our operations or other users.
We may also suspend or terminate services where required by law, sanctions rules, payment provider requirements, third-party carrier restrictions, technical limitations, or security concerns.
Termination or suspension does not affect any accrued rights, payment obligations, usage records, investigations, indemnities, disclaimers, or limitations of liability that by their nature should survive termination.
14. Disclaimers
To the maximum extent permitted by law, the services are provided on an “as is” and “as available” basis.
Roambit does not guarantee uninterrupted availability, continuous coverage, specific network speeds, compatibility with all devices, error-free operation, or that the services will always meet your expectations or requirements.
We disclaim, to the fullest extent permitted by law, all implied warranties, representations, and conditions, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted enjoyment.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Roambit and its affiliates, officers, directors, employees, agents, licensors, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of data, business interruption, or procurement of substitute services.
This applies whether the claim arises in contract, tort, negligence, strict liability, statute, or otherwise, even if we were advised of the possibility of such damages.
Without limiting the above, we are not liable for losses resulting from poor coverage, unavailable local networks, carrier restrictions, service interruptions, device incompatibility, SIM installation errors, deleted eSIM profiles, user error, third-party failures, disabled data roaming, incorrect APN settings, incorrect mobile data selection, incorrect network settings, unsupported or locked devices, refusal to follow troubleshooting instructions, or circumstances outside our reasonable control.
Where an eSIM has been successfully generated, delivered, installed, activated, connected, or verified as functional by Roambit or its telecom provider, Roambit shall not be liable for customer-side failures to configure, activate, select, or use the eSIM correctly, except where mandatory law provides otherwise.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the specific service giving rise to the claim shall not exceed the amount you paid for that specific service.
Nothing in these Terms of Service excludes or limits liability that cannot be excluded or limited under applicable law.
16. Indemnification
You agree to defend, indemnify, and hold harmless Roambit, its affiliates, officers, directors, employees, contractors, and partners from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your misuse of the services, your breach of these Terms of Service, your violation of applicable law, or your infringement of any third-party rights.
17. Governing Law and Jurisdiction
These Terms of Service and any non-contractual obligations arising out of or in connection with them shall be governed by the laws of Hong Kong, unless mandatory consumer protection laws in your jurisdiction require otherwise.
Subject to applicable mandatory law, the courts of Hong Kong shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms of Service.
18. Changes to These Terms
We may update these Terms of Service from time to time.
The latest version will always be posted on our website with an updated effective date. Where required, material changes may also be communicated through the website, the app, or by email.
Your continued use of the services after updated terms become effective constitutes acceptance of the revised Terms of Service.
